U.S. Supreme Court & Health Care Arguments

The United States Supreme Court has scheduled arguments March 26-28 to decide the constitutionality of the health care reform law. The arguments hinge on whether the United States Congress overreached in creating an individual mandate requiring Americans to purchase health insurance or pay a fine beginning in 2014. The administration has argued that Congress's ability to legislate an individual mandate to purchase health insurance is vested in the commerce clause of the Constitution, which gives Congress the power to regulate interstate commerce.

NLRB Amends Election Case Protocols

The National Labor Relations Board has adopted a final rule amending its election case procedures. The rule will be published in the Federal Register on Thursday, December 22, and is due to take effect on April 30, 2012.

The rule is primarily focused on procedures followed by the NLRB in cases in which parties can't agree on issues such as whether the employees covered by the election petition are an appropriate voting group. In such cases, the matter goes to a hearing in a regional office and the NLRB Regional Director decides the question and sets the election.
